A proposed Settlement has been reached with Capital One over the data=20
breach that Capital One announced on July 29, 2019, where Capital One's=20
computer network system was the target of an external criminal=20
cyberattack that began in March 2019 (the "Data Breach"). Plaintiffs=20
claim that Capital One and its cloud computing provider Amazon Web=20
Services ("Amazon") did not adequately protect their personal=20
information. Defendants deny any wrongdoing. No judgment or=20
determination of wrongdoing has been made.

Who is Included? You received this email because records indicate you=20
are included in this Settlement as a Class Member. The Class includes=20
the approximately 98 million U.S. residents identified by Capital One=20
whose information was accessed in the Data Breach.

What does the Settlement Provide? Capital One will establish a $190=20
Million Settlement Fund that will be used to pay for cash payments of up=20
to $25,000 for reimbursement of Out-of-Pocket Losses and Lost Time that=20
you believe are fairly traceable to the Data Breach, at least three=20
years of free Identity Defense Services, at least three years of free=20
Restoration Services, attorneys' fees, costs, and expenses, and costs of=20
notice and administration. Capital One has also agreed to adopt, pay=20
for, implement, and maintain extensive Business Practices Commitments=20
related to information security for a period of at least two (2) years.=20
All cash payments may be adjusted pro rata depending on the number of=20
Class Members that participate in the Settlement.

How To Get Benefits: You must submit a Claim Form, including any=20
required documentation. (You do not need to file a Claim to access the=20
Restoration Services.) The deadline to file a Claim Form is August 22,=20
