After two long weeks in federal court in the Southern District of New York,=
 a jury has decided that ETS Express is not liable on all counts=2E Bottles=
 like the h2go Force =E2=80=93 the bottle in question =E2=80=93 have existe=
d since long before S=E2=80=99well launched its product in 2010, argued Sha=
ron Eyal, CEO of ETS Express=2E The h2go Force bottle is currently sold by =
many resellers in the promotional products markets=2E =E2=80=9CA company ca=
n=E2=80=99t take an existing design, put their name on it and claim it=
=E2=80=99s theirs,=E2=80=9D Eyal told Counselor=2E

After sending a cease-and-desist letter to ETS in 2014, S=E2=80=99well serv=
ed the Southern California supplier last May=2E ETS filed a counterclaim fo=
r cancellation of S=E2=80=99well=E2=80=99s bottle design trademark registra=
tion, moving for a summary judgment=2E 

ETS argued that S=E2=80=99well=E2=80=99s bottle was not distinctive because=
 dozens of manufactures made similar cola-shape bottles=2E =E2=80=9CI feel =
vindicated that the jury ruled in ETS=E2=80=99s favor, and that we were abl=
e to deliver a win for the industry=2E=E2=80=9D Eyal said=2E
