ed California Proposition 65 warning labels for all eligible products are a=

k presentations, ESP Websites<sup>=E2=84=A2</sup> and ESP Mobile<sup>=
=E2=84=A2</sup>, meeting new guidelines in advance of a looming August 30 d=
eadline.</p>

ducts sold or used in California must carry a warning label if they contain=
 certain chemicals =E2=80=93 a growing list that already includes over 1,00=
0 chemicals. New amendments to 1986 regulations now mandate that in the war=
ning, manufacturers must specify the chemicals that cause cancer or birth d=
efects or other reproductive harm. Additionally, the warnings must now appe=
ar on internet and catalog product listings. Under Prop 65, businesses with=
 10 or more employees must provide =E2=80=9Cclear and reasonable=E2=80=
=9D warnings before knowingly and intentionally exposing individuals to che=
micals on the list.</p>

ng two months ago, ASI began updating all ESP and ESP Website applications =
and processes to ensure new supplier-provided Prop 65 warnings are now seen=
 in detail at every point a supplier, distributor and end-buyer could inter=

the warnings at least once, and often multiple times, ensuring they can sha=

ven, to the consumer before the purchase is completed (such as having the w=
arning appear when the shopper enters a California ZIP code into the shippi=
ng information fields during the checkout process). A warning does not sati=
sfy Prop 65=E2=80=99s requirements if the purchaser is required to search f=
or it.</li>

the new internet warnings, Swanholt and Titche said catalog warnings must b=
e =E2=80=9Cclosely associated=E2=80=9D with the product being warned about.=
 Given that there are no hyperlinks on paper catalog pages, these requireme=
nts will necessitate some creativity on the part of catalog producers to fi=
t the requisite warning language into each page=E2=80=99s layout. It is not=
 acceptable to provide a list of warnings in a glossary at the end of the c=
atalog; rather, each product must have the warning on the product page.</p>=


=09=09=09=09=09=09<p>=E2=80=9CASI did an incredible amount of work ov=
er the past several months, reaching out to all 3,200 suppliers to remind t=
hem of the need to comply,=E2=80=9D said Charles B. Machion, ASI=E2=80=
=99s senior vice president and senior counsel. =E2=80=9CWe touched every su=
pplier five times, sending reminders and information through regular mail a=
nd email to help them understand the law=E2=80=99s complexities and to make=
 compliance as simple as possible.=E2=80=9D</p>

he new regulations contain a caveat that says products manufactured before =
the August 30 deadline do not need to conform to the updated warning requir=
ements. Websites selling products and printed catalogs must prominently dis=
play the same warnings.</p>

=09=09=09=09=09=09<p>According to PromoGra=
m, if manufacturers or distributors don=E2=80=99t apply warnings, they leav=
e themselves open to Prop 65 =E2=80=9Cbounty hunters=E2=80=9D =E2=80=93 law=
 firms that bring private citizen suits against violators to score an easy =
pay day. In 2016, there were nearly 1,110 settlements for a total of $40 mi=
llion. Promotional products distributors and suppliers must deal with an ad=
ded layer of complexity, because even if they sell products to an end-buyer=
 in another state, those products could still potentially be given away or =
sold in California.</p>
